SOVISART TERMS OF SERVICE

These Terms of Service ("Terms") form a binding agreement between you ("User", "Client", "Student") and the business operating under the trading name Sovisart — Design School ("Sovisart", "we", "us", "our"), governing your access to and use of sovisart.com (the "Site") and any online courses, digital lessons, templates, and downloadable materials offered through sovisart.com (the "Store" and associated pages).

By accessing the Site, enrolling in a course, or purchasing any digital product, you agree to be bound by these Terms. If you do not agree, do not use the Site or Store.
SECTION 1 // WHAT SOVISART IS
1.1. Sovisart is a design school. Its courses are Sovisart's own original curriculum, designed and taught directly by its founder — a designer ranked #3 in the world by Creativepool. Courses are delivered as structured online courses, live sessions, recorded video lessons, and supporting digital materials (templates, guides, and design files).

1.2. Every course includes the standard components listed on its product page, which may include: (a) recorded video lessons, (b) live sessions or Q&A calls (where scheduled), (c) written materials, templates, or design files, and (d) access to a dedicated Sovisart support channel for questions about the course content, available for the duration stated on the product page. The exact components of each course are specified in its product listing.

1.3. Sovisart is not a subscription content library. Course access is granted for the specific course purchased, for the access period stated on the product page (typically the duration of the live cohort plus a defined post-course access window). No product under these Terms grants open-ended or unrestricted access to an ongoing, unrelated content catalog unless explicitly sold as such.
SECTION 2 // PRICING AND PRODUCT CATALOG
2.1. Current courses, products, and prices are published on the live Store at sovisart.com and are governed by the Sovisart Pricing Policy, which is incorporated into these Terms by reference. These Terms do not restate specific prices, which may change at any time per the Pricing Policy.

2.2. All transactions are processed in US Dollars (USD) by Paddle, acting as Merchant of Record (see Section 6).

2.3. Split payments. Where a course is offered with a split-payment option (e.g. two instalments), both instalments are part of a single purchase and a single enrollment; non-payment of a later instalment may result in suspension of access pending payment, as detailed on the product page at checkout.
SECTION 3 // ELIGIBILITY AND ACCOUNT
3.1. Age Requirement. By completing a purchase or creating an account, you represent and warrant that you are at least 18 years of age, or the age of majority in your jurisdiction, whichever is higher, and that you have full legal capacity to enter into this agreement. This representation is made by you at the moment of purchase. Because course access is granted immediately upon payment, a confirmed purchase cannot be reversed solely on the basis that the purchaser did not meet this age requirement; responsibility for ensuring eligibility rests with the person initiating the transaction.

3.2. Account Information. Where an account or personal-cabinet login is required for course delivery, you agree to provide accurate contact information, including a valid email address, and to keep it current. This is the channel used for lesson delivery, schedule notices, and billing notifications.

3.3. One account is intended for use by one natural person. Credential sharing, pooled access, or group-purchase schemes are prohibited and may result in suspension without refund, consistent with Section 7 of these Terms.

3.4. Consent Logging. At checkout, you are required to confirm your agreement to these Terms, the Pricing Policy, the Refund Policy, and the Privacy Policy by checking a mandatory confirmation box. The timestamp, document version references, and your email address associated with this confirmation are logged and retained as a record of your consent.
SECTION 4 // COURSE DELIVERY
4.1. Enrollment and Access. Upon successful payment, you are granted a personal, non-transferable license to access the purchased course's video lessons, materials, and any associated live sessions for the access period stated on the product page, delivered via the personal-cabinet login associated with your account.

4.2. Live Cohort Elements. Where a course includes scheduled live sessions (e.g. live reviews, Q&A, webinars) tied to a specific cohort start date, these are delivered according to the published schedule for that cohort. Enrolling after a cohort has started may mean missing earlier live sessions; recorded materials, where available, remain accessible per Section 4.1.

4.3. Bundled products (e.g. a course sold together with templates or bonus materials) are sold as a single indivisible unit unless the product listing states otherwise. Components within a bundle cannot be unbundled, exchanged, or substituted for components of a different bundle.
SECTION 5 // INTELLECTUAL PROPERTY, LICENSE, AND DIGITAL IDENTIFICATION
5.1. Ownership. All video lessons, course materials, templates, design files, trademarks, and related creative and technical content available through Sovisart are the exclusive intellectual property of Sovisart, protected under applicable international copyright law. The usage license granted to you upon purchase is a copyright-based personal-use license and does not transfer any ownership or proprietary rights to you.

5.2. License Grant. Upon successful payment, Sovisart grants you a non-exclusive, non-transferable, revocable, personal-use license to access and use the purchased course materials for your own private, non-commercial learning purposes. Where a course explicitly includes commercially-usable templates or design assets, the specific commercial-use terms for those assets are stated on the relevant product page and override this default restriction for that asset only.

5.3. Restrictions. Without Sovisart's prior written consent, you may not: (a) resell, sublicense, rent, lend, or redistribute any Sovisart video, document, template, or design file, in whole or in part; (b) record, re-upload, publicly screen, or broadcast course video lessons or live sessions; (c) use Sovisart course content, templates, or materials for machine learning or AI model training of any kind; (d) share your account login or personal-cabinet access with any other person; (e) modify, remove, or attempt to circumvent any embedded file metadata, watermarks, or ownership attribution data embedded in Sovisart materials.

5.4. Digital Identification. Sovisart may embed unique digital identification data — including order reference identifiers and delivery metadata or watermarks — within delivered course materials. This data is used solely to identify the origin of files in the event of unauthorized redistribution and to protect Sovisart's intellectual property. This information does not contain personal financial data and is processed in accordance with the Privacy Policy.

5.5. Violation of any restriction in Section 5.3 results in immediate license termination without refund, and Sovisart reserves the right to pursue all available legal remedies, including the use of embedded digital identification data as evidence in enforcement proceedings.

5.6. DMCA and Copyright Infringement. To report unauthorized use or redistribution of Sovisart content, or to submit a copyright infringement notice, contact: info@sovisart.com with the subject line "Copyright Notice". Sovisart will investigate all credible reports and take appropriate action.

5.7. Third-Party Links. The Site may contain links to third-party websites or platforms used in connection with course content or delivery. Sovisart is not responsible for the content, privacy practices, or terms of service of any third-party site. Links are provided for informational and preview purposes only.
SECTION 6 // PAYMENT, MERCHANT OF RECORD, AND BILLING
6.1. All payments are processed by Paddle.com Market Limited and its applicable affiliates ("Paddle"), acting as Merchant of Record. Paddle is the seller of record for tax, invoicing, and payment-processing purposes, and your transaction is also subject to Paddle's own buyer terms.

6.2. Instalment Billing. Where you select a split-payment option, authorizing the first payment authorizes the agreed remaining instalment(s) at the interval and amount displayed at checkout. You may contact us regarding a change in circumstances before a scheduled instalment; non-payment may result in suspension of access per Section 2.3.

6.3. Refunds, cancellation mechanics, and chargeback handling are governed by the Sovisart Refund Policy, incorporated into these Terms by reference.
SECTION 7 // ACCEPTABLE USE
7.1. You agree not to: circumvent or attempt to circumvent any access or licensing controls; use automated tools to bulk-download or scrape the Site, Store, or course materials; misrepresent your identity, age, or payment details to obtain access you are not entitled to; remove or tamper with embedded digital identification data in Sovisart materials; or use the Site, Store, or course materials for any unlawful purpose.

7.2. Sovisart applies reasonable technical safeguards, including access monitoring and embedded digital identification in delivered files, to protect the platform and its intellectual property. Accounts found in material breach of this Section may be suspended or terminated without refund, subject to the Refund Policy.
SECTION 8 // DISCLAIMERS, "AS-IS" BASIS, AND LIMITATION OF LIABILITY
8.1. No Guaranteed Outcome. Sovisart courses are educational products. We do not guarantee any specific learning outcome, income, client result, employment result, or certification equivalent to a formal accredited diploma. Your results depend on factors outside our control, including your own effort, prior experience, and market conditions. Statements about potential outcomes made on the Site or in marketing materials are illustrative, not a promise of individual results.

8.2. Not Professional/Financial Advice. Course content relating to pricing, monetization, or business practices reflects the instructor's own experience and opinion, and does not constitute financial, legal, or tax advice. You are responsible for your own business, tax, and legal decisions.

8.3. Technical Requirements. Access to course materials requires a stable internet connection, a modern web browser, and, where applicable, a third-party software account subject to that provider's own terms of service, which is not provided or controlled by Sovisart. Sovisart is not liable for access issues arising from your own equipment, software, or third-party service availability.

8.4. As-Is Basis and Service Availability. All Sovisart products are provided on an "as is" and "as available" basis. Sovisart makes no guarantee of any specific level of platform uptime beyond the initial delivery of course access. Sovisart exercises sole creative and editorial discretion over the content, format, and schedule of its courses. Subjective dissatisfaction with creative content, teaching style, or stylistic choices does not constitute a defect and is not grounds for a refund beyond what is stated in the Refund Policy.

8.5. Limitation of Liability. To the maximum extent permitted by applicable law, Sovisart's total liability for any claim arising from your use of the Site, Store, or courses is capped at the amount you paid for the specific product giving rise to the claim. Sovisart is not liable for indirect, incidental, or consequential damages of any kind.

8.6. Force Majeure. Sovisart is not liable for delays or failures in delivery or platform availability caused by events outside its reasonable control, including third-party hosting or platform outages, internet infrastructure failures, or other force majeure events.
SECTION 9 // CHANGES TO THESE TERMS
9.1. Sovisart may update these Terms from time to time. Material changes will be reflected by an updated Effective Date and Document Ref at the top of this document, and active account holders will be notified by email. Continued use of the Site or Store after an update constitutes acceptance of the revised Terms.

9.2. Jurisdiction Update. These Terms currently reflect Sovisart operating as a pre-incorporation individual business. In the event that Sovisart incorporates as a registered legal entity, the merchant details and governing law provisions in these Terms and the associated policy documents will be updated accordingly, and active students will be notified by email prior to the change taking effect.
SECTION 10 // GOVERNING LAW AND DISPUTES
10.1. These Terms are governed by the laws of Montenegro, without regard to conflict-of-law principles. Disputes arising under these Terms shall first be addressed through Sovisart's support channel (Section 11), and, where applicable, through Paddle's buyer dispute-resolution mechanisms for payment-related matters.

SECTION 12 // MISCELLANEOUS
12.1. Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

12.2. Entire Agreement. These Terms, together with the Sovisart Pricing Policy, Refund Policy, and Privacy Policy, constitute the entire agreement between you and Sovisart regarding the subject matter herein, and supersede all prior written or oral representations, communications, and agreements, including any statements made through support channels.

12.3. No Waiver. Sovisart's failure to enforce any right or provision of these Terms on any occasion does not constitute a waiver of that right or provision, and Sovisart reserves the right to enforce such rights or provisions at any time.
SECTION 13 // LANGUAGE
These Terms are executed in English. Any translated version is provided for convenience only; the English version governs in the event of any conflict.
